This Privacy Policy (hereinafter referred to as the "Policy") aims to explain the types of personal data collected by Avalue Technology Inc. (hereinafter referred to as "Avalue" or "the Company") when you interact with the Company and use its websites and related services, as well as how the Company uses, shares, and protects your personal data. By accessing, browsing, or using Avalue’s websites, products, and services, you acknowledge that you have fully read, understood, and agreed to accept the entire contents of this Policy.

This Policy applies to all interactions between you and Avalue, as well as various services and platforms provided by Avalue, as exemplified below:

I. Collection of Personal Data

Avalue collects your personal data only within the necessary scope to ensure the normal operation of services and to provide you with an optimized website and service experience. Certain personal data is provided directly by you, such as information submitted when registering an account, using the Member Center, filling out contact or inquiry forms, applying for RMA after-sales services, submitting customer service tickets, subscribing to marketing emails, or participating in various events organized by Avalue. Furthermore, we acquire certain data by recording your interactions with the Company’s websites and services, such as through the use of Cookies, tracking tools, or other similar technologies, to collect information regarding website usage status, browsing behavior, and performance.

(I) Types of Data Provided Directly by You

Depending on the context of your interaction with Avalue, the types of personal data we may collect include, but are not limited to, the following items:

  • Name, Contact, and Professional Information: Such as name, company name, department/job title, email address, and phone number (the phone field may be optional).
  • Account and Authentication Data: Including registration information using an email address as the account ID, account settings data, and verification and security-related information such as passwords.
  • After-Sales / RMA and Technical Support Data: Such as product serial numbers, device identification information (e.g., MAC address, UUID, etc.), descriptions of issues or malfunctions, system logs, screenshots, etc. Such data may contain personal data or identifiable information. To protect your privacy, we recommend avoiding the provision of unnecessary sensitive personal data.
  • Customer Service and Ticket Correspondence Data: Including problem descriptions, attachments, processing records, and correspondence messages between both parties provided in customer service tickets or service requests.
  • Event-Related Data: Contact or identification information required for event registration; photography or video recording may also be conducted during events.

(II) Types of Data Collected by the Website (e.g., Cookie Tools)

When you access the Company’s website, we may automatically collect data related to your device and usage, such as:

  • Device, Connectivity, and Configuration Data: IP address, browser type, operating system, device identification information, language settings, etc.
  • Website Usage Data: Pages browsed, click and interaction behaviors, duration of stay, referring pages, etc.

We use Cookies to support website operations and measurement. For an explanation of Cookie types, please refer to the section "How to Access and Control Your Personal Data" in this Policy.

(III) Data Obtained from Third Parties

Avalue does not obtain potential customer lists from distributors/agents; does not purchase lists from suppliers; does not exchange lists with joint marketing partners; and does not supplement contact information from public sources.

(IV) Your Option to Provide Data

When you are requested to provide personal data, you may decline. However, if you choose not to provide data required for certain products or features, you may be unable to use such products or features (e.g., failure to provide necessary contact information may result in the inability to complete inquiry responses or ticket processing); alternatively, providing insufficient or incorrect data may affect service quality or integrity. If the personal data you provide intentionally impersonates another person, violates public order or good morals, infringes upon the rights of others, or is suspected of violating other laws or regulations, we reserve the right to refuse or cancel your use of our services, and you shall bear all legal liabilities.

II. Use of Personal Data

The data collected by Avalue is primarily used for the following purposes:

  • Provision and Operation of Services: Including member registration and account management, responding to inquiries, providing customer service, and RMA after-sales services, etc.
  • Customer Service and Notifications: Including ticket processing, service-related communications, and necessary notifications.
  • Service Improvement and Statistical Analysis: Including website usage analysis, performance measurement, and service enhancement.
  • Protection, Security, and Dispute Resolution: Including the detection, prevention, or handling of cybersecurity incidents and abusive behaviors, rights protection, dispute resolution, and regulatory compliance.
  • Marketing Promotions and Communications: Including sending marketing emails (unsubscribe options/preference adjustments are available as described below).

(I) Website Analytics and Advertising Performance Measurement

  • Avalue uses Google Analytics for website usage analysis.
  • Avalue uses Google Ads Conversion Tracking for advertising performance measurement.
  • Avalue does not engage in retargeting, nor does it conduct interest-based advertising.

(II) Marketing Electronic Direct Mail (EDM)

Avalue may send marketing emails via NewsLeopard. EDMs may include tracking technologies to measure delivery effectiveness (e.g., open rates and clicks), as detailed in the section "Tracking User Email Opening Status" below.

III. Sharing of Personal Data

(I) Avalue shares your personal data under the following circumstances:

  • When you have consented, or when it is necessary to provide the services you have requested.
  • Within the necessary scope for outsourced vendors to perform entrusted tasks.
  • When necessary to comply with laws or to protect rights and safety.

Detailed explanations are as follows:

1. Outsourced Service Providers

Avalue may provide necessary data to vendors or their agents to assist in fulfilling the purposes described in this Policy. For example:

  • Taiwan IDC Data Center Services: Providing website hosting and system maintenance.
  • NewsLeopard (EDM/Marketing Delivery Platform): Providing email delivery and performance measurement.

However, Avalue will require entrusted vendors to comply with the Company’s confidentiality regulations and information security requirements, and will execute necessary supervision to ensure that your personal data is processed or utilized only within the scope of the entrusted purpose.

2. Legal, Regulatory Authorities, and Rights Protection

When we have reasonable grounds to believe it is necessary, Avalue may access, transfer, disclose, or retain personal data (limited to the necessary scope):

  • To comply with applicable laws or respond to legal processes (including requests from judicial units or competent authorities).
  • To protect the rights, property, or safety of users, the Company, or others (including dispute resolution, litigation, enforcing agreements, or preventing fraud, abuse, or major cybersecurity incidents).
  • To maintain and operate the security of the Company’s systems and websites (including preventing or stopping attacks).

3. Third-Party Links

The Company’s website may contain third-party links (e.g., Facebook, YouTube, LinkedIn) or embedded third-party content (e.g., YouTube videos). If you interact with third-party services, your data will be governed by the privacy policies of those third parties; Avalue is not responsible for the collection and processing practices of such third parties.

IV. How to Access and Control Your Personal Data

(I) Your Communication Preferences (EDM Unsubscribe/Preference Settings)

  • You can manage marketing preferences through the Member Center:

  • You may also cease receiving emails by utilizing the one-click unsubscribe mechanism provided in each marketing email.

(II) Cookies and Browser-Based Controls

1. The Role of Cookies

  • Necessary Cookies: Certain Cookies are strictly necessary for website operations (e.g., login and basic functions/information security). If you disable Necessary Cookies, parts of the website may not function.
  • Performance/Analytics Cookies:We use such Cookies to analyze how visitors use the website and to monitor website performance to improve content and experience (e.g., using Google Analytics).

However, Avalue currently does not use Functional Cookies (to remember language/preferences), nor does it use Marketing/Advertising Cookies for interest-based advertising or remarketing.

2. Blocking or Deleting Cookies

You can block or delete Cookies in your browser settings. However, if you choose to disable Cookies, certain parts of the website may not function properly, or measurement accuracy may be affected.

(III) Do Not Track (DNT)

Avalue understands the importance users place on privacy. However, due to the current lack of a unified industry standard regarding the definition and technical implementation of "Do Not Track" (DNT) signals issued by browsers, the Company does not currently process DNT signal requests. This will be re-evaluated once standards are established in the future.

(IV) Tracking User Email Opening Status

Emails sent by Avalue via NewsLeopard may contain tracking technologies (such as single, unique web beacons) to determine whether the email has been opened and to measure clicks on email links. Avalue may use this information to improve email content and delivery effectiveness; you may unsubscribe at any time.

V. Legal Bases for Processing Personal Data

Avalue collects, processes, or utilizes your personal data solely based on the following legal grounds:

  • Performance of Contract:We process your data when it is necessary to provide the services you have explicitly requested. For example:completing the member registration process, responding to your inquiry requests, or providing Customer Service (CS) or Return Merchandise Authorization (RMA) services.
  • Legitimate Interests:Processing personal data for the purposes of maintaining our service operations, executing information security protection, conducting internal management and quality improvement, performing research and analysis, and protecting the Company’s rights, provided that such processing does not unduly infringe upon your rights and privacy.
  • Compliance with Legal Obligations:We must process relevant personal data to comply with applicable laws, regulations, and formal requests from competent authorities.
  • Consent:When required by law to obtain consent, or when the Company relies on consent as the basis for data processing (e.g., specific Cookie settings, receiving marketing communications), we will seek your consent. You have the right to withdraw this consent at any time; the withdrawal of data does not affect the lawfulness of processing based on consent before its withdrawal.

VI. Retention Period of Personal Data

Avalue will retain your personal data to fulfill the purposes for which it was collected, and may continue to retain and use it based on laws, contracts, or dispute resolution requirements.

Criteria used to determine retention periods include:

  • Whether subject to restrictions by law, contract, or similar obligations (e.g., statutory retention, investigations, litigation needs).
  • Whether it is still necessary to provide services or process your requests (e.g., account validity period, after-sales support period).
  • Whether it is necessary for the prevention of fraud and abuse, security protection, rights protection, and dispute resolution.

Personal data processed by the Company’s systems is, in principle, handled domestically and is not open to remote access by overseas colleagues or affiliates.

However, third-party services used by the Company (such as Google-related services or EDM platforms) may involve their own data processing locations and cross-border transfer determinations; the Company will adopt necessary measures in accordance with applicable laws to protect your privacy and rights.

VIII. Privacy Protection

Avalue adopts reasonable technical and organizational security measures in accordance with internal regulations and relevant laws to prevent accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data. Security measures include, but are not limited to:

  • TLS/SSL Encrypted Transmission
  • Access Control and the Principle of Least Privilege
  • Backup and Recovery Mechanisms
  • Security Monitoring, Intrusion Detection, and Vulnerability Patching Processes
  • Regular Audits or External Testing
  • Personal Data Incident Notification Procedures (evaluation, reporting, and necessary notifications will be conducted in accordance with applicable laws)
